The Supreme Court has set aside the “status quo ante bellum” order earlier issued by the Court of Appeal in Abuja in the leadership dispute within the African Democratic Congress.
The judgment means that the executive led by David Mark is restored after it was earlier delisted by the Independent National Electoral Commission. In a unanimous decision on Thursday, a five-member panel led by Justice Mohammed Lawal Garba ruled that the order by the Court of Appeal was not necessary.
The apex court also held that the appeal on jurisdiction was filed wrongly, as it was based on an ex parte order asking parties to show cause without first getting proper approval from the appellate court. More details on the case are expected later.
